TERMS & CONDITIONS
The “Just so you knows” and “just in cases”
for the 1:1 sessions, events, workshops and 1-day retreats
1. Definitions
1.1 Coach and service provider: Grace Lucky Janssen, owner of ‘The Lucky Project’ and ‘the soulpreneurs collective’, MSc. In Managing People Knowledge & Change and Executive Master in Finance & Control, working as a self-employed coach, mentor and trainer.
1.2 Coachee: the person receiving the mentoring, coaching or training.
1.3 Client: the organization paying for the coaching or training.
2. General
2.1 The Lucky Project: registered at the Dutch Chamber of Commerce in Amsterdam with registration number 80863280, provides online and offline services related to mentoring, coaching, presentations, trainings, workshops and social media.
2.2 Grace Lucky Janssen delivers her services to the best of her abilities and will do everything possible to support the coachee/client in achieving his/her own results and desired outcomes. However, Grace Lucky Janssen is not responsible for the success and accomplishments of her services, nor for the achievements of the defined goals of the client/coachee.
3. Agreement
3.1 This agreement is applicable to all services, projects, soulpreneur events, one-day retreats, sessions, assignments, trainings, discounts and activities provided by and agreed with Grace Lucky Janssen.
3.2 This agreement is also applicable to potential future assignments.
3.3 Grace Lucky Janssen has the right to change or adjust the agreement in the future.
4. Prices, fees, invoices, payments
4.1 Prices on the webpage, price quotes, assignments and other publications are excluding VAT, excluding other charges, such as, but not limited to, shipping, handling, administration, and travel costs, unless explicitly stated otherwise.
4.2 Price quotes and fees do not automatically apply to future sessions, assignments or packages.
4.3 For individual sessions, the invoice is shared within 3 working days after the payment has been made.
4.4 For group workshops or ‘the soulpreneurs collective’ events, invoices can be requested via email to thesoulpreneurscollective@gmail.com
4.4 Payments are to be paid to bank account number NL34 ASNB0267158629 to G.L. Janssen.
4.5 The client shares the required business details (address, VAT, etc) in order for Grace Lucky Janssen to provide the correct details on the invoice.
5. Termination
5.1 Either the client/coachee or the coach may terminate this agreement at any time through written notice. As a client/coachee I agree to compensate the coach for all coaching services rendered through and including the effective date of termination of the coaching relationship.
6. Client satisfaction
6.1 Grace Lucky Janssen is committed to provide the best possible skills and services and to do everything in her power to make sure the client/coachee will achiever his/her goals in the most effective way.
6.2 Grace Lucky Janssen engages in training and continues to further develop herself through education.
7. Duration of sessions
7.1 The average duration of a coaching session is 120 minutes. In some cases, sessions may be completed earlier or later.
7.2 The duration of events, workshops or one-day retreats are specified on the website and in the confirmation emails.
8. Responsibility
8.1 As a client/coachee I understand that I am solely responsible for creating and implementing my own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and coaching calls and interactions with Grace Lucky Janssen. As such, I agree that Grace Lucky Janssen is not and will not be liable or responsible for any actions or inaction of me, or for any direct or indirect result of any services provided by her. As a client/coachee I understand mentoring or coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease.
8.2 I acknowledge that I may terminate or discontinue the relationship at any time.
9. Coaching / mentoring
9.1 I understand that coaching does not involve the diagnosis or treatment of mental disorders and that coaching is not to be used as a substitute for counselling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is my exclusive responsibility to seek such independent professional guidance as needed for legal, medical, financial, professional, spiritual or other matters.
9.2 I acknowledge that all decisions within these areas are exclusively my own and I understand that my decisions and relation actions are my own responsibility.
9.3 I understand that in order to enhance the relationship, I agree to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program.
10. Therapy
10.1 I hereby declare that, in case I am currently under the care of a mental health professional, I have informed the mental health care provider of the nature and extent of the coaching/mentor relationship agreed upon by me and Grace Lucky Janssen.
11. Confidentiality
11.1 All information will be treated confidential, unless I state otherwise in written form, or when legally determined.
11.2 Grace Lucky Janssen will never, directly nor indirectly, use, share nor communicate information with third parties, unless required to perform the services.
11.3 I understand that topics may be anonymously and hypothetically shared with other coaching professionals for training, supervision, mentoring, evaluation, and for coach professional development and/or consultation purposes.
12. Liability
12.1 I understand that coaching is a comprehensive process that may involve different areas of my life, including work, finances, health, relationships, education and recreation. I agree that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively my own responsibility. I understand that I am entirely responsible for my own action within and outside the coaching relationship.
12.2 I acknowledge that Grace Lucky Janssen is in no way liable for any loss or damages whether direct, indirect or consequential which I may suffer in reliance directly or indirectly on all or any part of the services. I shall indemnify and hold harmless Grace Lucky Janssen from and against any and all actions, claims, liabilities, proceedings or demands which may be brought against them.
12.3 Except as expressly provided in this agreement, Grace Lucky Janssen makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall she be liable to the client/coachee for any indirect, consequential or special damages. Nevertheless, Grace Lucky Janssen is committed to offering the highest quality services and to continue to further engage in training and education to further develop herself in her areas of expertise.
13. Additional information
13.1 Coaching or mentor sessions may occur in person, by phone or through video conference, depending on the location of Grace Lucky Janssen and the preference of the client/coachee.
13.2 Grace Lucky Janssen will provide a timely ZOOM invitation for online sessions.
13.3 The coach and client/coachee agree to be present at the agreed time, both online and in person.
13.4 For in person sessions applies the following: the client/coachee is responsible for transportation, unless agreed otherwise.
14. Cancellations
14.1 The client/coachee can cancel or reschedule an appointment at least 24 hours in advance, without a change fee. Any changes or cancellations within 24 hours will not be refunded.
14.2 The client/coachee can cancel at least 7 days in advance for a one-day retreat , without any change in fee. Any changes or cancellations less than 7 days in advance will not be refunded.
